It allows counterfeiters to file false insurance claims and even to buy medical equipment illegally. This valuable commodity is leading to an \u003Ca rel=\"noreferrer noopener\" href=\"https:\u002F\u002Fwww.hipaajournal.com\u002Fhealthcare-data-breach-statistics\u002F\" target=\"_blank\">increased incidence of compromised healthcare records\u003C\u002Fa>. HIPAA has been monitoring these incidents since 2009 and their accumulated figures show that while the number of incidents increases year after year, their impact (number of exposed records, number of compromised records) varies. \u003C\u002Fp>\n\n\n\n\u003Cp>However, we are talking about some whopping numbers here:\u003C\u002Fp>\n\n\n\n\u003Cul class=\"wp-block-list\">\n\u003Cli>Between October 21, 2009 and the end of 2023, 5,887 large healthcare data breaches have been reported.\u003C\u002Fli>\n\n\n\n\u003Cli>There was no letup in cyberattacks on healthcare organizations in 2023, which set two new records: the most reported data breaches and the most breached records. Last year 725 data breaches were reported to the Office for Civil Rights (only registers cases with 500+ records) and across those breaches, more than 133 million records were exposed or impermissibly disclosed. \u003C\u002Fli>\n\n\n\n\u003Cli>In 2023, 79.7% of data breaches were due to hacking incidents.&nbsp;\u003C\u002Fli>\n\u003C\u002Ful>\n\n\n\n\u003Ch3 class=\"wp-block-heading\">\u003Cstrong>An influx of data to deal with\u003C\u002Fstrong>\u003C\u002Fh3>\n\n\n\n\u003Cp>Forecasts put the amount of digital data by 2025 at \u003Ca href=\"https:\u002F\u002Fdev.to\u002Faws-builders\u002Fthere-will-be-175-zettabytes-of-data-in-the-world-by-2025-where-will-we-store-it-1ck4\" target=\"_blank\" rel=\"noreferrer noopener\">175 zettabytes\u003C\u002Fa> or 175 trillion gigabytes. Digital health tools’ contribution to this \u003Cem>very\u003C\u002Fem> significant chunk of data isn&#8217;t negligible as their \u003Ca href=\"https:\u002F\u002Ffinance.yahoo.com\u002Fnews\u002Fdigital-health-market-forecasted-reach-062100319.html#:~:text=Key%20Points%20and%20Statistics%20on,USD%201%2C592%20Billion%20by%202032.\" target=\"_blank\" rel=\"noreferrer noopener\">market share is steadily increasing\u003C\u002Fa>. The very authorities safeguarding this information must handle this major influx of sensitive data with extreme caution. And we can extrapolate from recent examples to see how this can play out.\u003C\u002Fp>\n\n\n\n\u003Cp>During \u003Ca rel=\"noreferrer noopener\" href=\"https:\u002F\u002Fmedicalfuturist.com\u002Fsenators-dont-understand-facebook-will-make-sense-digital-health\u002F\" target=\"_blank\">Facebook’s Cambridge Analytica scandal\u003C\u002Fa>, millions of users’ information was compromised without their knowledge. When Mark Zuckerberg faced Senators during his hearing, the main take-home message was that politicians understand little regarding the tech industry’s functioning. Here authorities took the lead in addressing similar issues. The private genetic sequencing company, DeCode Genetics, \u003Ca rel=\"noreferrer noopener\" href=\"https:\u002F\u002Fwww.technologyreview.com\u002F2015\u002F03\u002F25\u002F168797\u002Fgenome-study-predicts-dna-of-the-whole-of-iceland\u002F\" target=\"_blank\">could identify all of the country’s inhabitants\u003C\u002Fa> who are at risk of breast cancer due to a defective, inherited gene. DeCode Genetics could do this by extrapolating on the genetic data it already sequenced from Icelanders as part of a study, but the rest who could be identified didn’t take part in or knew about this research. The country’s regulators ruled that neither the government nor private companies should identify and inform individuals of such risks without prior consent to access their genetic data.\u003C\u002Fp>\n\n\n\n\u003Cp>With the ever-increasing volume of sensitive information, similar conflicts are bound to emerge in the coming years. Policymakers should take the lead in regulating and handling these issues, rather than lag behind.\u003C\u002Fp>\n\n\n\n\u003Ch3 class=\"wp-block-heading\">\u003Cstrong>The Epic case\u003C\u002Fstrong>\u003C\u002Fh3>\n\n\n\n\u003Cp>While authorities traditionally kept our data safe in the ivory towers of medicine, we, the patients, could not proof-check the information gathered about us. However, turning this around can help fix data errors and offer additional insights. One of the stars of the e-patient community, \u003Ca rel=\"noreferrer noopener\" href=\"https:\u002F\u002Fparticipatorymedicine.org\u002Fepatients\u002F2009\u002F04\u002Fimagine-if-someone-had-been-managing-your-data-and-then-you-looked.html\" target=\"_blank\">e-Patient Dave\u003C\u002Fa> emphasized this back in 2009. How would you know if potentially life-saving information about you is right or wrong if you can&#8217;t look into those records yourself?\u003C\u002Fp>\n\n\n\n\u003Cfigure class=\"wp-block-embed aligncenter is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\">\u003Cdiv class=\"wp-block-embed__wrapper\">\n\u003Ciframe loading=\"lazy\" title=\"Superpatients - In Conversation With E-patient Dave Debronkart\" width=\"640\" height=\"360\" src=\"https:\u002F\u002Fwww.youtube.com\u002Fembed\u002FJDtQFoFKt2s?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen>\u003C\u002Fiframe>\n\u003C\u002Fdiv>\u003C\u002Ffigure>\n\n\n\n\u003Cp>However, the attitude of barring access to one’s medical records has little changed. In 2020, Epic, the largest electronic health record (EHR) company in the U.S., \u003Ca rel=\"noreferrer noopener\" href=\"https:\u002F\u002Fwww.statnews.com\u002F2020\u002F01\u002F27\u002Fepic-should-support-health-data-rule-not-block-it\u002F\" target=\"_blank\">downplayed the federal government’s effort\u003C\u002Fa> to enable easier access to one’s electronic health data. Epic’s CEO \u003Ca rel=\"noreferrer noopener\" href=\"https:\u002F\u002Fwww.cnbc.com\u002F2020\u002F01\u002F22\u002Fepic-ceo-sends-letter-urging-hospitals-to-oppose-hhs-data-sharing-rule.html\" target=\"_blank\">wrote to hospital administrators\u003C\u002Fa>, nudging them to disapprove of the proposed rules. Critics went on to highlight how Epic has done little to favor health data interoperability between different EHR systems and that the company even “\u003Cem>imposes information blocking\u003C\u002Fem>.” A \u003Ca rel=\"noreferrer noopener\" href=\"https:\u002F\u002Fjamanetwork.com\u002Fjournals\u002Fjamanetworkopen\u002Ffullarticle\u002F2705850\" target=\"_blank\">study showed\u003C\u002Fa> how some healthcare institutions give patients “c\u003Cem>onflicting information about requesting their records and, in many cases, give blatant misinformation or limited information\u003C\u002Fem>.”\u003C\u002Fp>\n\n\n\n\u003Cp>Giving patients agency over their health information by giving them clear access to it should be promoted, not hampered. Such access allows them to have second opinions easily, switch providers if necessary and even download the data that institutions have about them. If major actors don’t support this view, then outsiders will come into play.\u003C\u002Fp>\n\n\n\n\u003Cp>For instance, \u003Ca rel=\"noreferrer noopener\" href=\"https:\u002F\u002Fsupport.apple.com\u002Fen-us\u002FHT208680\" target=\"_blank\">Apple’s Health app\u003C\u002Fa> lets users view all of their health data and even allows them to delete the data from their app. The \u003Ca rel=\"noreferrer noopener\" href=\"https:\u002F\u002Fhugo.health\u002F\" target=\"_blank\">Hugo Health\u003C\u002Fa> platform connects patients with their medical data and only moves data with their permission. For instance, fitness wearables giant Garmin was targeted when hackers \u003Ca rel=\"noreferrer noopener\" href=\"https:\u002F\u002Fwww.wired.com\u002Fstory\u002Fgarmin-ransomware-hack-warning\u002F\" target=\"_blank\">halted the services\u003C\u002Fa>, threatening users’ data. However, it might help to look at how other countries are handling similar situations.&nbsp;\u003C\u002Fp>\n\n\n\n\u003Cp>We mentioned how Iceland dealt with private company mining for information without consent. In another example, the Estonian government \u003Ca rel=\"noreferrer noopener\" href=\"https:\u002F\u002Fmedicalfuturist.com\u002Fdigital-healthcare-in-estonia\u002F\" target=\"_blank\">secures genetic and healthcare information\u003C\u002Fa> with blockchain technology. The transparency it offers allows authorities and even patients to get to know who looked up individual health data. Healthcare professionals who did so without the proper authorization \u003Ca rel=\"noreferrer noopener\" href=\"https:\u002F\u002Fmedicalfuturist.com\u002Fwhat-happens-when-genomics-meets-politics\u002F\" target=\"_blank\">were fined or even fired\u003C\u002Fa> from their respective medical institutions. And of course, Google also \u003Ca href=\"https:\u002F\u002Fwww.nature.com\u002Farticles\u002Fd41586-019-03574-5\" target=\"_blank\" rel=\"noreferrer noopener\">had its share\u003C\u002Fa> of \u003Ca href=\"https:\u002F\u002Ftechcrunch.com\u002F2022\u002F05\u002F16\u002Fgoogle-deepmind-nhs-misuse-of-private-data-lawsuit\u002F\" target=\"_blank\" rel=\"noreferrer noopener\">similar scandals\u003C\u002Fa>. \u003C\u002Fp>\n\n\n\n\u003Cp>Experts stress \u003Ca rel=\"noreferrer noopener\" href=\"https:\u002F\u002Fhealthitanalytics.com\u002Fnews\u002Fprivacy-protection-key-for-using-patient-data-to-develop-ai-tools\" target=\"_blank\">the need to de-identify data\u003C\u002Fa> for such purposes; and that, ideally, there should be no involvement of financial transactions when using clinical data for research and the development of AI models. Regulators should further keep tech companies in check in these matters. \u003C\u002Fp>\n\n\n\n\u003Cp>An example is how the U.K. Information Commissioner’s Office (ICO) \u003Ca rel=\"noreferrer noopener\" href=\"https:\u002F\u002Fwww.bbc.com\u002Fnews\u002Ftechnology-40483202\" target=\"_blank\">investigated the breach of the law\u003C\u002Fa> when the Royal Free NHS Foundation Trust shared large amounts of patient data with Google’s DeepMind AI branch to develop a new platform. The Trust \u003Ca rel=\"noreferrer noopener\" href=\"https:\u002F\u002Fwww.medicaldevice-network.com\u002Ffeatures\u002Fdata-privacy-advertising-amazon-and-artificial-intelligence\u002F\" target=\"_blank\">did not inform patients properly\u003C\u002Fa> about the use of their data for this purpose. It had to set up a legal basis for future data processing, complete a privacy impact assessment, and commission an independent audit.\u003C\u002Fp>\n\n\n\n\u003Cp>Will regulators and policymakers step up in similar situations in the future? Or are we expected to give away our information to those companies that can subsequently further profit off of these data?\u003C\u002Fp>\n\n\n\n\u003Ch2 class=\"wp-block-heading\">\u003Cstrong>Upgrades and guidance required for the digital health era\u003C\u002Fstrong>\u003C\u002Fh2>\n\n\n\n\u003Cp>As we’ve seen, privacy and security issues of the digital health era are complex and multi-factorial.
